This Product Warranty Agreement ("Agreement") is entered into between Elitra ("Manufacturer") and the purchaser ("Customer") of Elitra-branded products ("Product").
Warranty Coverage:
Manufacturer warrants that the Product shall be free from defects in materials and workmanship under normal use and service for a period of 180 Days (6 Months) from the date of purchase ("Warranty Period").
During the Warranty Period, the Manufacturer will, at its option, repair or replace any defective Product or component thereof, free of charge, subject to the terms and conditions of this Agreement.
Exclusions:
This warranty does not cover damage caused by misuse, abuse, accident, neglect, unauthorized modification, or improper installation.
This warranty does not cover normal wear and tear, cosmetic damage, or damage caused by acts of nature or disasters.
This warranty does not cover Products purchased from unauthorized resellers or refurbished Products.
Claim Process:
To make a warranty claim, the customer must contact Elitra Customer Support within the Warranty Period.
The customer may be required to provide proof of purchase and/or photographic evidence of the alleged defect.
Upon receipt of a valid warranty claim, Manufacturer will provide instructions for returning the defective Product, if applicable.
Limitation of Liability:
Manufacturer's liability under this Agreement shall be limited to the repair or replacement of the defective Product or component thereof.
In no event shall the Manufacturer be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with the Product or this Agreement.
Governing Law:
This Agreement shall be governed by and construed in accordance with the laws of [Jurisdiction], without regard to its conflict of law provisions.
Entire Agreement:
This Agreement constitutes the entire agreement between Manufacturer and Customer regarding the warranty of the Product, and supersedes all prior or contemporaneous communications and proposals, whether oral or written, between the parties.
By purchasing an Elitra-branded Product, the customer acknowledges and agrees to be bound by the terms and conditions of this Warranty Agreement.
